Agreement
These Terms of Service (“Terms”) are an agreement between you and Odd Syntax Studios LLC (“we,” “us”), an Ohio limited liability company. They govern your use of the CatchYak AI mobile app (the “app”). Our website has its own website terms. By downloading or using the app, you agree to these Terms. If you don’t agree, don’t use the app.
Safety disclaimer
CatchYak AI provides fishing and safety-related suggestions based on weather, water, and environmental data. These are informational only and do not replace your own judgment, experience, or on-water conditions assessment. Kayaking and fishing carry inherent risks including but not limited to weather changes, water hazards, and capsizing. You are solely responsible for your own safety, equipment, and decisions on the water. Odd Syntax Studios LLC and CatchYak AI assume no liability for injury, loss, or damage resulting from use of this app.
Safety ratings, launch windows, wind and weather readings, routes, and “when to head in” suggestions are estimates drawn from forecasts and third-party data that may be delayed, incomplete, or wrong for the exact spot where you are. Always check conditions yourself, wear a properly fitted life jacket, carry the safety equipment required where you paddle, tell someone your plan, and stay off the water when in doubt. The app is not an emergency service and is not a navigation instrument.
Who can use the app
You must be at least 13 years old to use the app. If you are under the age of majority where you live, you may use the app only with the involvement and permission of a parent or guardian, who agrees to these Terms on your behalf.
Your license to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your own non-commercial use, under these Terms and the usage rules of the store you downloaded it from. You may not copy, modify, reverse engineer, resell, or redistribute the app, or use it to build a competing product, except as the law expressly allows.
AI-generated content
Bite reports, trip plans, routes, lure suggestions, and spot advice are generated by artificial intelligence from the conditions and details provided to it. AI output can be inaccurate, out of date, or inappropriate for your situation, and it may describe places, structures, or depths that don’t match what you find on the water. Treat it as a starting point, not as fact or professional instruction.
Your responsibilities
- Hold any fishing license required where you fish, and follow all fishing, boating, and wildlife laws, including seasons, size and bag limits, and protected areas.
- Follow the rules of each lake and launch, such as motor restrictions, hours, and access permissions. The app may not know every local rule.
- Respect private property and get permission where it is required.
- Don’t use the app in a way that is unlawful, interferes with its operation, or attempts to access our systems or the services behind them without authorization.
Third-party data and services
The app relies on outside providers for weather, maps, places, and AI. We don’t control those providers and aren’t responsible for their availability or accuracy. Features may change or stop working if a provider changes or ends its service.
Subscriptions
When a Pro subscription becomes available, it will be sold through the Apple App Store or Google Play. Price and billing period will be shown before you confirm. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period, and you can manage or cancel them in your App Store or Google Play account settings. Refunds are handled by Apple or Google under their policies. We may change subscription features or prices; price changes apply to your next renewal and will be communicated as the store requires.
Beta versions
Beta or test versions, including builds distributed through Apple TestFlight, are provided for evaluation. They may be incomplete, contain errors, or stop working, and features may change or be removed. Feedback you send us may be used to improve the app without obligation to you.
Your content
Catches, photos, notes, and other information you enter belong to you. They are stored on your device, and you are responsible for backing them up. We don’t claim ownership of your content.
Our property
The app, its design, illustrations, text, and the CatchYak AI and Odd Syntax Studios names and logos belong to Odd Syntax Studios LLC or its licensors and are protected by law. These Terms don’t give you any right to use them except to use the app as permitted.
No warranties
THE APP AND ALL INFORMATION IN IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON’T WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ITS WEATHER, SAFETY, OR FISHING INFORMATION WILL BE ACCURATE OR COMPLETE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Odd Syntax Studios LLC AND ITS MEMBERS, OFFICERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOSS OF EQUIPMENT OR DATA, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APP OR RELIANCE ON ITS INFORMATION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM OR FIFTY U.S. DOLLARS. Some places don’t allow certain limitations, so some of these may not apply to you.
Indemnity
You agree to defend and hold harmless Odd Syntax Studios LLC from claims, damages, and expenses, including reasonable attorneys’ fees, arising from your use of the app, your activities on the water, or your violation of these Terms or of any law.
Ending your use
You can stop using the app at any time by deleting it. We may suspend or end your access if you violate these Terms or if we discontinue the app. Sections that by their nature should survive, including the safety disclaimer, no-warranty, limitation of liability, and indemnity sections, survive termination.
Governing law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Ohio, and you consent to their jurisdiction, except where the law of your place of residence gives you the right to bring a claim elsewhere.
App store terms
If you downloaded the app from the Apple App Store, you also agree that:
- These Terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims, and claims that the app infringes someone else’s intellectual property.
- You represent that you are not located in a country subject to a U.S. government embargo or listed on a U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded the app from Google Play, Google Play’s terms of service also apply to your download and any purchases.
Changes to these Terms
We may update these Terms. We will post the new version here with a new effective date and, for significant changes, tell you in the app. Continuing to use the app after a change means you accept the updated Terms.
